The new time registration rules in brief
According to the new law, it is now mandatory for all employers to introduce a system for recording employees’ working hours. The purpose of the requirement is to implement the practice of the European Court of Justice regarding the registration of employees’ daily working hours in order to ensure that the employer complies with the occupational health and safety regulations for working hours, included the 48-hour rule , and that it is documented in a system.
More specifically, this means that you, as an employer, are obligated to introduce an“objective, reliable and accessible working time registration system“, which makes it possible to measure the daily working hours for each individual employee.

The 48 hour rule
The 48-hour rule is created to ensure orderly conditions for employees. The 48-hour rule states that the employee may work no more than 48 hours over a seven-day period, averaged over a period of four months – including overtime. Periods of paid holiday and periods of sick leave are not included in the calculation of the average.
It does not matter what time during the year the four months fall. However, it must be four consecutive months.
The rule applies to all employees. However, employees who have a collective agreement which ensures them at least the same rights as the Working Time Act are exempt.
It is the employer’s responsibility to comply 48-hour rule, and if you break the rule by letting an employee work more than 48 hours per week on average in a period of four months, the employee is entitled to compensation. You have to pay an allowance to your employee, which is typically between DKK 25,000–50,000 – even if the employee wanted to work overtime.
